According to the provisions of the "National Product Quality Law" and other relevant regulations passed by the 22nd National People's Congress on February 22, 1993, the following requirements must be met:
1. The product must have a quality inspection certificate.
2. The product name, manufacturer’s name, and address must be clearly marked in Chinese. Imported products sold domestically must also bear a Chinese label.
3. Based on the product’s characteristics and usage, specifications, grades, and the names and contents of the main components should be indicated.
4. Products with limited use must include the production date or expiration date. For packaged food, the production date, shelf life, or duration should be specified.
5. For products that may cause damage or pose risks to people or property, warning signs or instructions in Chinese must be provided.
6. Registered trademarks approved by the industry and commerce authorities should be marked with "(R)" or "TM".
7. Patents granted by the patent office can be indicated on the product.
8. Manufacturers must mark the standard code, number, and name on the product or its packaging.
9. Products that have obtained national quality certification can display the corresponding safety or certification marks.
10. Barcodes – The State Bureau of Technical Supervision requires all products entering the market to be barcoded.
(B) Special Provisions in Packaging Design
1. Glass-bottled beer must be labeled with warnings such as “Do not strike, prevent explosion,†issued by the General Administration of Quality Supervision, Inspection and Quarantine and the National Standards Commission. According to the “General Rules for the Labeling of Prepackaged Beverage Wines,†from October 1, 2007, bottled beer must carry the warning “Do not strike, prevent blasting.â€
2. The term “fresh†cannot be used casually. Under new rules, pre-packaged foods that have undergone thermal processing cannot be named “fresh XX.†For example, pasteurized milk heated to 75°C-80°C or room-temperature sterilized milk at 137°C cannot be called “fresh milk.†Similarly, drinks containing only a small amount of juice can no longer be labeled as “fresh juice.â€
3. Alcohol labels must include health warnings. All alcoholic beverages with an alcohol content above 0.5 degrees, including beer, wine, fruit wine, and white wine, must feature warnings such as “Excessive drinking is harmful to health,†“Do not drive after drinking,†and “Pregnant women and children should not consume alcohol.†These warnings are mandatory under labeling standards.
(C) Regulations Related to Food Packaging Design
In October 2006, two new national standards for the labeling of prepackaged special dietary foods were implemented. Foods that do not meet these standards cannot be sold.
1. The label name must be genuine. New names, exotic names, or transliterated names can be used, but they must align with national or industry standards. If not specified, the common name reflecting the true nature of the food must be used to avoid misleading consumers. For example, “yogurt butter†should be labeled as “sour milk.â€
2. Foreign languages must be smaller than Chinese characters. Except for registered trademarks, all pre-packaged food must use standard Chinese characters. Any foreign language or pinyin used must not exceed the size of the corresponding Chinese characters.
3. Production dates must be clearly marked. The production date refers to the date when the finished product was inspected and released by the manufacturer. It must be clearly stated on the package and cannot be replaced with vague terms like “see packaging.â€
4. Genetically modified foods must be labeled. All foods listed in the “Administrative Measures for the Labeling of Agricultural Genetically Modified Organisms†must be labeled as “genetically modified food.†Examples include soybean oil, corn oil, and genetically modified tomatoes.
5. Claims implying health benefits are prohibited. Foods for special diets, such as infant or diabetic foods, must include nutritional information. Terms like “prevent,†“treat,†or “cure†for specific diseases are not allowed.
6. Preservatives must be clearly named. Ingredients should be listed in descending order of quantity. For example, water, sweeteners, preservatives, and colorants must be clearly labeled with their specific names or codes.
7. Product names and font sizes must be consistent. Labels must not confuse consumers by using different font sizes to mislead them. For instance, in “orange juice drink,†“orange juice†and “beverage†should be the same size.
These updated regulations aim to enhance transparency, protect consumer rights, and ensure accurate and informative packaging across all product categories.
